TICA Registered Kitten Sales Contract

This contract is between Dilbar Tayir (the breeder) and __________________ (the buyer).

This is a legal and binding contract concerning the purchase of a purebred Ragdoll kitten from DreamiiDolls.

This contract is designed to protect the buyer, the breeder, and the welfare of the kitten.

Deposit & Payment Terms

This kitten is purchased as a Pet for the total amount of $_________ CAD, with a non-refundable deposit of $800 CAD.

The deposit holds the kitten exclusively for the buyer until the remaining balance is paid.

The remaining balance of $_________ CAD must be paid in full before the kitten’s departure.

The remaining balance may be settled in person on the day of pickup. If paying by Interac e-Transfer, the full amount must be received no later than 48 hours before pickup.

If the buyer decides not to proceed with the purchase, the deposit will be forfeited, unless otherwise agreed upon in writing by the breeder.

The breeder reserves the right to withhold the kitten if full payment has not been received or confirmed by the applicable deadline.

 

Conditions of Sale:

  1. The buyer and the breeder acknowledge and agree that this kitten is being purchased as a pet.

  2. The kitten will be spayed/neutered by the breeder prior to going to the new home. TICA registration papers will be provided after delivery of the kitten.

  3. The breeder guarantees that this kitten is healthy to the best of her knowledge, at the time of sale.
    The buyer must have the kitten examined by a licensed veterinarian within 72 hours of pickup or delivery.
    If any health concerns are found during this examination, the buyer must notify the breeder immediately and provide a written statement from the attending veterinarian explaining the findings.
    The buyer may return the kitten to the breeder within 7 days for a full refund of the purchase price.
    No medical, diagnostic, or travel expenses will be refunded.

  4. During the first 7 days, this kitten must be isolated from any other pets and monitored for health, eating, litter box usage, and activity level. The breeder is not responsible for any injury or illness to other pets caused by exposure to this kitten.

  5. The breeder assumes no liability or responsibility for any veterinary care for this kitten after the buyer takes possession of said kitten. Under no circumstances will the breeder be responsible for any veterinary bills incurred by the buyer.

  6. The breeder warrants this kitten against fatal congenital/genetic defects for a period of 5 years. The breeder will replace the cat when one becomes available or refund the purchase price. The buyer will provide the breeder with a necropsy at the buyer’s expense, stating the cause of death is unquestionably a congenital/genetic defect.

  7. The breeder confirms that both parents of the kitten have been DNA-tested and are negative/clear for all currently known Ragdoll-associated genetic mutations, including but not limited to: HCM (MYBPC3 R820W mutation), PKD1 (Polycystic Kidney Disease). As these mutations are the only scientifically confirmed genetic variants associated with these diseases in Ragdolls, a Clear × Clear pairing cannot produce genetically affected offspring for these conditions. Therefore, any occurrence of HCM or PKD in the kitten shall not automatically be considered a hereditary or congenital defect, unless conclusively proven by a certified veterinary cardiologist or geneticist.

  8. The buyer understands that Hypertrophic Cardiomyopathy (HCM) in cats can be multifactorial in origin. While certain HCM cases are genetic, many are acquired, developmental, stress-induced, or secondary to respiratory or systemic conditions, and are not the result of a congenital defect. A diagnosis of HCM does not in itself constitute proof of a genetic or congenital disorder. Only cases explicitly confirmed by a board-certified veterinary cardiologist to be congenital in origin shall fall under the congenital/genetic defect warranty in this contract.

  9. The buyer understands that general practice veterinarians are not able to definitively determine whether a heart condition— including Hypertrophic Cardiomyopathy (HCM)—is congenital, hereditary, or acquired. Only a board-certified veterinary cardiologist has the expertise and diagnostic tools necessary to evaluate the origin and severity of cardiac conditions. For the purpose of this agreement, any diagnosis relating to heart disease (including HCM) must be confirmed by a board-certified cardiologist. Only when the cardiologist explicitly states in writing that the condition is congenital in origin will it fall under the congenital/genetic defect warranty described in this contract.

  10. If, after the deposit has been received and before the kitten leaves for the buyer’s home, the kitten becomes seriously ill, suffers a life-threatening condition, or passes away due to unforeseen circumstances, the breeder shall immediately inform the buyer and refund the deposit in full.
    The breeder shall not be held liable for any additional costs, losses, or emotional distress beyond the amount of the deposit.

  11. The breeder is not responsible or liable for any non-genetic illnesses, veterinary expenses, or health conditions that may occur after the kitten leaves the cattery.
    This includes, but is not limited to, conditions such as upper respiratory infections, parasites, bacterial or viral infections, or other illnesses that can be contracted in the environment after pickup or delivery.
    The breeder’s health guarantee applies only to congenital or hereditary defects as stated in this agreement.
    The buyer acknowledges that once the kitten has passed the initial veterinary examination period, the breeder assumes no further responsibility for any non-genetic illnesses or medical costs incurred thereafter.

  12. This kitten will be kept indoors and not be allowed to roam freely outdoors, for its safety and wellbeing.

  13. Under no circumstances shall this kitten/cat be sold, leased, traded, or given away to any pet store, animal shelter, research laboratory, breeding operation, or similar facility.
    The buyer shall not rehome, sell, or transfer ownership of the kitten/cat to any third party without the breeder’s prior written consent.

  14. The buyer agrees that this kitten is not to be declawed or all health guarantees are voided. This cattery considers this surgery inhumane and does not agree with this practice.

  15. The breeder does not warrant the kitten against any adverse reactions to future vaccinations, anesthetic, or surgeries.

  16. If the buyer decides to return the kitten within 14 days of going home for personal reasons, including but not limited to family allergies, incompatibility with other pets, or changes in personal circumstances (such as work or travel), the breeder will accept the kitten back and will find a new home for it.
    In such cases, the buyer must return the kitten along with all original documents, including but not limited to the TICA registration papers, vaccination records, health certificate, and any other paperwork provided at the time of sale.
    Upon safe return of the kitten and confirmation that the kitten is in good health, the breeder will refund 50% of the total purchase price to the buyer.
    The remaining 50% will be retained by the breeder to cover expenses related to care, veterinary evaluation, and rehoming of the kitten.

  17. The buyer agrees to provide the kitten with proper nutrition, fresh water, clean living conditions, and adequate sanitary facilities.
    The buyer shall ensure that the kitten receives regular veterinary care, vaccinations, and claw trimming, and that a suitable scratching post is available.
    The kitten must not be confined to a cage for extended periods, except when medically necessary or for its safety.

  18. If, at any time in the future, the buyer can no longer keep the kitten, the breeder must be notified immediately. The buyer may return the kitten/cat to the breeder, and the breeder will assist in finding a suitable new home. No refund will be provided in such cases.
    This is to ensure that none of the breeder’s kittens end up in a shelter or rescue situation.

  19. In the event of any concern, issue, or misunderstanding regarding the kitten or this agreement, the buyer must first contact the breeder directly to discuss and attempt to resolve the matter in good faith. The breeder agrees to make every reasonable effort to assist and communicate with the buyer to address any questions or concerns. The buyer further agrees not to post, share, or publish any defamatory, misleading, or negative comments, reviews, or statements about the breeder or the cattery in any online or public forum without first allowing the breeder the opportunity to respond and resolve the issue.

  20. Any legal disputes arising under this agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
    The parties agree that any action or proceeding arising out of or relating to this agreement shall be filed exclusively in the courts located in Simcoe County, Ontario.

  21. This agreement constitutes the entire understanding between the Buyer and the Breeder. No verbal promises or representations are binding unless stated in writing and signed by both parties.

Governing Law Notice

This contract is governed by the laws of Ontario, Canada.
Any dispute arising from this agreement shall be resolved in a court located in Simcoe County, Ontario.
The buyer shall be responsible for any legal fees and court costs incurred by the breeder in enforcing this agreement.
